If you have any questions, please let us know.
The following Terms and Conditions of Service apply to all products and services provided by Be Noticed Design (hereinafter referred to as Be Noticed) and in the event of any dispute are governed by the laws of England.

All work is carried out by Be Noticed Design on the understanding that the client has agreed to our terms and conditions.

Copyright is retained by Be Noticed Design on all design work including words, pictures, ideas, visuals and illustrations unless specifically released in writing and after all costs have been settled.

When a choice of designs is presented to the client for a project carried out by Be Noticed Design, only the selection final choice of design is deemed to be released to the client as fulfilling of the contract. All other designs remain the property of Be Noticed Design, unless specifically agreed in writing.

Project Acceptance

At the time of a given project proposal submitted to the given client, Be Noticed will provide the customer with a written estimate or quotation by email. These Terms and Conditions can be read at any time on the Be Noticed website.

A copy of the written estimate or quotation is to be signed and dated by the customer to indicate acceptance and should be returned to Be Noticed.

For the avoidance of doubt, the Be Noticed Terms & Conditions are what govern the job, not any conditions a customer stipulates within their Terms and Conditions.

Design Charges

Charges for design services to be provided by Be Noticed Design and are set out in the written quotation that is provided to the client. Once the client has signed the formal project quote, it is deemed that the client has given formal acceptance of a given quotation, indicating acceptance of the Terms & Conditions and payment terms. Once an outlined project stage has been completed, an invoice is raised and due. This invoice has to be settled upon receipt, before the next stage can be started.

Source Files

We will supply appropriate format proofs, typically PDF files at various outlined stages of a project, as detailed in the job scope. Charges for design work do not cover the release of our copyright design source files, including but not restricted to ID, PSD, Ai, PNG or other source files or raw code; if the Client requires these files for transfer to an in-house or other design entity, they will be subject to a separate quotation or ‘buy-out’ charge. Design release fees can however be inclusive to a project quote, but subject to being explicitly agreed and formally outlined in a project quote, before a project begins.

Charges for Other Services

Charges for any additional services requested during the project that are over and above the estimated time or out of scope, will become fully payable (100% of the quoted amount) at the time of submission of the given additional work. Clients will be issued a formal quote for the additional work and asked to sign, agreeing to pay for the additional time outlined.

Payment

Invoices are due and payable upon receipt of Invoice. Any invoice queries must be submitted by email within 14 days of the invoice date. Accounts which remain outstanding for 30 days after the date of invoice, will incur late payment interest charge of 8% of the invoice total per week.

Payments may be made by online transfer or Paypal. Payments made by cheque must be previously agreed and may be subject to an administration charge. Cheques should not be sent in regular mail unless sent recorded delivery. Publication and/or release of work done by Be Noticed Design on behalf of the client, may not take place before cleared funds have been received.

Returned cheques will incur an additional fee of £50 per returned cheque. Be Noticed Design reserves the right to consider an account to be in default in the event of a returned cheque.
